These Terms and Conditions (“Terms”) govern the use of the Africaribana Go platform, including its website, mobile applications, ordering system, vendor tools, and delivery coordination services operated by Africaribana Businesses INC (“Africaribana”, “we”, “our”, or “us”).
Africaribana Go is a digital platform that connects customers, restaurants, grocery vendors, and independent delivery partners for the purpose of facilitating food and grocery ordering and delivery.
By accessing or using Africaribana Go, you agree to comply with and be bound by these Terms.
If you do not agree with these Terms, you should not use the platform.
1. Platform Role and Nature of Service
Africaribana Go operates strictly as a technology marketplace platform.
The platform allows:
• Customers to place orders from restaurants and grocery vendors
• Vendors to list and sell products online
• Independent delivery partners to fulfill deliveries
Africaribana does not prepare food, manufacture products, or operate restaurants or grocery stores.
Africaribana also does not employ delivery drivers.
The platform functions solely as an intermediary that facilitates transactions between independent parties.
All purchases made through Africaribana Go are transactions directly between the customer and the vendor.
2. Eligibility
Users of the Africaribana Go platform must:
• Be at least 18 years of age
• Provide accurate registration information
• Comply with all applicable laws in Canada
Africaribana reserves the right to refuse service, suspend accounts, or remove users who violate these Terms.
3. Customer Responsibilities
Customers using Africaribana Go agree that:
• Orders placed through the platform are fulfilled by independent vendors
• Africaribana does not control vendor preparation methods or ingredients
• Delivery times are estimates and may vary
Customers must provide accurate:
• Delivery address
• Contact information
• Order details
If a customer is unavailable to receive an order, the order may be considered delivered without refund.
Customers must behave respectfully toward vendors, drivers, and platform staff.
4. Vendor Responsibilities (Restaurants and Grocery Stores)
Vendors using Africaribana Go operate as independent businesses.
Vendors are solely responsible for:
• Food preparation
• Ingredient accuracy
• Product safety and freshness
• Compliance with local health and safety regulations
• Packaging orders properly for delivery
Vendors must maintain:
• Valid business operations where required
• Compliance with Canadian food safety standards
• Accurate product descriptions and pricing
Africaribana reserves the right to remove vendors that repeatedly fail to meet platform standards.
5. Delivery Partner Terms
Delivery partners on Africaribana Go operate as independent contractors and are not employees of Africaribana.
Delivery partners are responsible for:
• Maintaining valid driver licenses
• Maintaining required insurance coverage
• Following applicable traffic and safety laws
• Delivering orders in a professional and timely manner
Africaribana does not control the working hours, routes, or operational decisions of delivery partners.
6. Pricing, Payments and Platform Fees
Prices displayed on Africaribana Go may include:
• Vendor product prices
• Delivery charges
• Platform service fees
• Applicable sales taxes
Payments are processed through secure third-party payment processors.
Africaribana may deduct applicable platform commissions or service fees before vendor payouts.
All charges will be displayed before checkout confirmation.
7. Refunds and Order Disputes
Customers must report order issues within 24 hours of delivery.
Refunds may be considered for:
• Missing items
• Incorrect items
• Delivery failures
• Significant quality issues
Africaribana may issue:
• Full refunds
• Partial refunds
• Platform credits
Refund decisions are made at Africaribana’s discretion.
Where vendor errors are confirmed, refund costs may be deducted from vendor payouts.
8. Food Safety and Vendor Liability Disclaimer
Africaribana Go does not control food preparation practices of vendors listed on the platform.
Vendors are fully responsible for:
• Food hygiene
• Ingredient disclosure
• Allergen labeling
• Compliance with health department regulations
Customers with allergies or dietary restrictions should contact vendors directly prior to placing orders.
Africaribana shall not be liable for:
• Foodborne illness
• Contamination
• Ingredient mislabeling
• Allergic reactions
These matters remain the responsibility of the vendor.
9. Delivery Risks and Limitations
Delivery services on Africaribana Go may be performed by:
• Independent delivery partners
• Third-party delivery networks
Delivery times are estimated and may be affected by:
• Traffic conditions
• Weather conditions
• Vendor preparation delays
• Driver availability
Africaribana does not guarantee delivery times.
10. Lost Orders and Driver Misconduct
While Africaribana strives to maintain reliable delivery services, delivery partners operate independently.
Africaribana shall not be responsible for losses resulting from:
• Driver negligence
• Order theft
• Delivery accidents
• Driver misconduct
Customers must report delivery issues through the platform for investigation.
Africaribana may determine resolutions at its sole discretion.
11. Prohibited Conduct
Users, vendors, and drivers may not:
• Engage in fraudulent activity
• Manipulate reviews or ratings
• Misrepresent products or services
• Upload malicious software
• Attempt to disrupt platform systems
• Harass other users
Violations may result in suspension or permanent removal from the platform.
12. Platform Availability
Africaribana Go may experience temporary interruptions due to:
• System maintenance
• Software upgrades
• Technical failures
• Network outages
Africaribana does not guarantee uninterrupted platform availability.
13. Indemnification
Users, vendors, and delivery partners agree to indemnify and hold harmless Africaribana Businesses INC, its employees, officers, and affiliates from any claims, damages, liabilities, or legal expenses arising from:
• Use of the platform
• Vendor products or services
• Delivery partner actions
• Violations of these Terms
14. Limitation of Liability
Africaribana operates solely as a technology platform connecting independent parties.
To the maximum extent permitted by law, Africaribana shall not be liable for:
• Vendor product quality issues
• Food preparation errors
• Delivery delays
• Driver misconduct
• Indirect or consequential damages
Africaribana’s total liability for any claim shall not exceed the amount paid for the order involved.
15. Force Majeure
Africaribana shall not be liable for delays or failures caused by events beyond its reasonable control including:
• Natural disasters
• Government restrictions
• Strikes or labor disruptions
• Severe weather
• System outages caused by external providers
16. Intellectual Property
All Africaribana platform systems including:
• Software
• Platform architecture
• Logos and branding
• Technology infrastructure
are owned by Africaribana Businesses INC.
Unauthorized copying, distribution, or reproduction is prohibited.
17. Privacy
Africaribana collects and processes personal information in accordance with Canadian privacy laws including PIPEDA.
Information collected may include:
• Names
• Contact information
• Delivery addresses
• Order history
• Payment information
Personal information is used solely for platform operations and service improvement.
18. Account Suspension or Termination
Africaribana reserves the right to suspend or terminate accounts belonging to customers, vendors, or delivery partners who:
• Violate these Terms

• Abuse the platform
• Fail to meet operational standards
19. Changes to Terms
Africaribana may modify these Terms periodically.
Updated Terms will be published on the platform with a revised effective date.
Continued use of the platform constitutes acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of Ontario, Canada.
Any disputes related to Africaribana Go shall be resolved within the courts of Ontario.

Failure to comply may result in account restrictions, suspension, or permanent removal from the platform.
1. Respectful Community Behavior
Africaribana Go is built to support businesses and communities. All users are expected to interact respectfully.
Users must not:
• Harass vendors, drivers, or customers
• Use abusive, discriminatory, or threatening language
• Engage in intimidation or hostile behavior
• Disrupt the operations of vendors or delivery partners

2. Honest Use of the Platform
Users must use Africaribana Go honestly and responsibly.
The following activities are prohibited:

Fraudulent activity may result in permanent account removal.
3. Vendor Responsibilities
Restaurants and grocery vendors using Africaribana Go must maintain professional standards.
Vendors must not:

• Sell unsafe, expired, or contaminated food products
• Engage in deceptive pricing practices
• Discriminate against customers
Vendors must comply with applicable food safety regulations and maintain proper hygiene practices.
Africaribana reserves the right to remove vendors that fail to maintain acceptable standards.
4. Delivery Partner Conduct
Delivery partners represent the final stage of the customer experience and must act professionally.
Delivery partners must:
• Deliver orders safely and responsibly
• Treat customers and vendors respectfully
• Follow traffic laws and safety regulations
• Handle food orders carefully
Delivery partners must not:
• Tamper with orders
• Steal customer orders
• Harass customers or vendors
• Misuse customer information
Violations may result in removal from the delivery network.
5. Platform Integrity
Users must not attempt to interfere with the Africaribana Go platform.
Prohibited actions include:
• Attempting to hack or disrupt platform systems
• Uploading malicious software or viruses
• Manipulating platform features
• Attempting unauthorized access to platform data
Such actions may result in legal action where applicable.
6. Review and Rating Integrity
